Siddaramaiah has option of challenging in court guv’s sanction for prosecution

Karnataka CM

Siddaramaiah

has the option to contest governor’s decision by filing a petition in the

Karnataka HC

. If HC dismisses his plea, he can escalate the matter to Supreme Court. The legal grounds for challenging the sanction could include arguments related to governor’s authority, procedural lapses or lack of a prima facie case against him. The

legal battle

could be a protracted one, potentially delaying immediate repercussions.

Siddaramaiah’s position as CM remains strong due to overwhelming support he received from his party and cabinet. Congress has rallied behind him and state cabinet condemned governor’s decision as unconstitutio-nal. Given the solidarity, the likelihood of his resigning appears slim.
Congress high command might view the situation as politically motivated and could opt to defend him vigorously, both legally and publicly. With their backing, Siddaramaiah is likely to dismiss opposition’s calls for his resignation. He could argue that similar situations in the past did not lead to the

resignation

of others.
For instance, former CM BS Yediyurappa continued in office even after the then governor sanctioned his

prosecution

in connection with an alleged mining scam. However, with

governor’s sanction

, Siddaramaiah’s legal troubles could mount as social activist Snehamayi Krishna had also moved special court for people’s representatives over MUDA site allotment scam.

Earlier, the proceedings had come to a standstill with the special court observing that request for governor’s sanction was pending. Now, Siddaramaiah will be forced to challenge Krishna’s petition. His legal team could argue for rejection of the petitions on various grounds, including procedural impropriety. Outcome in special court will be crucial in determining course of proceedings.
